Mayor Karpan called the city council meeting to order at 7:00 p.m.

Council members present: Fisher, Brown, Herold and Russell. Council member Fisher was absent.

Approval of Agenda
A motion was made by Alexander to approve the agenda. Seconded by Brown. Ayes-All. Motion carried.

Approval of July 6th and August 3rd 2015 Minutes

A motion was made by Herold to approve the consent agenda. Seconded by Brown. Ayes-All. Motion carried.

OPEN PUBLIC HEARING: Proposed Closing of Alley North of Lots 4, 5, 6 in Block 1 in B & M Addition to the Original Town of Dallas, Iowa, now known as Melcher-Dallas, Iowa

A motion was made by Alexander to open the public hearing. Seconded by Brown. Ayes-All. Motion Carried.

CLOSE PUBLIC HEARING

A motion was made by Alexander to close the public hearing. Seconded by Herold. Ayes-All. Motion carried.

NEW BUSINESS

1) Approval of Resolution 2015-48 (Resolution Directing The Sale of An Interest in Real Property Following the Public Hearing)
A motion was made by Russell to approve Resolution 2015-48. Seconded by Alexander. Ayes: Russell, Brown, Alexander. Abstain: Herold. Motion Carried.

2) Approval of Resolution 2015-49 (Resolution Approving the Transfer of Funds from LOST to General for Seal Coat Project)
A motion was made by Herold to approve Resolution 2015-49. Seconded by Brown. Ayes-All. Motion carried.

3) Approval of Resolution 2015-50 (Approval of Melcher-Dallas Credit Card Policy)
A motion was made by Herold to approve Resolution 2015-50. Seconded by Brown. Ayes-All. Motion carried.

4) Approval of Overnight Stay for Training for Officer DeRonde
A motion was made by Herold to approve the overnight stay and training for Officer DeRonde. Seconded by Brown. Ayes-All. Motion carried.

5) Approval for Mike Damon and Gary Comer to Attend Distribution and Leak Detection Workshop
A motion was made by Herold to approve training and that Mike and Gary will take the city truck. Seconded by Brown. Ayes-All. Motion carried.

6) Approval for Officer Johns to Attend OWI/Domestic Violence Training
A motion was made by Herold to approve training for Officer Johns. Seconded by Brown. Ayes-All. Motion carried.

7) D&S Grocery 3rd Tobacco Violation and Possible Action
A motion was made by Brown to accept the third tobacco violation acknowledgment. Suspension of the tobacco license will be from Sept. 1st -30th. Seconded by Russell. Ayes-All. Motion carried.

8) Approval of First Consideration of Ordinance 127 (Amending Animal Control Ordinance 55; Sections 14, 16, and 17)
A motion was made by Brown to approve the first consideration of Ordinance 127. Seconded by Herold. Ayes-All. Motion carried.

9) Approval to Waive Second and Third Consideration of Amended Ordinance 127
A motion was made by Herold to waive the 2nd and 3rd consideration of Ordinance 127. Seconded by Brown. Ayes-All. Motion carried.

10) Approval to Re-Appoint Ron Durham to the Zoning Board
A motion was made by Herold to approve the appointment of Ron Durham to the zoning board. Seconded by Brown. Ayes-All. Motion carried.

11) Discuss Forgiving Portion of Utility Bill Due to Water Leak with Possible Action
A motion was made by Herold to forgive a one-time water leak at 405 SW 1st. Seconded by Brown. Ayes-All. Motion carried.

12) Discuss Ordinance 135.13 (Driveway Culvert Description) with Possible Action
Tabled

13) Open Bids for Tree Removal

14) Discuss Digging Out Ditches/Cleaning Out Driveway Culverts with Possible Action

OLD BUSINESS

15) Approval of Second Consideration of Ordinance 126 (Adding a New Section Regarding Raising Urban Chickens)
A motion was made by Russell to approve the second consideration of ordinance 126 and that current poultry owners will not have to erect a fence unless the original structure (coop and yard) is moved or damaged and then rebuilt. Seconded by Brown. Ayes: Brown, Alexander, Russell. Nays: Herold.

16) Discuss City’s Comprehensive Plan with Possible Action
Tabled-The agreement will be sent to the city lawyer for review.

17) Discuss Dilapidated Building Owned by Lloyd Hedrick
